Terms and conditions for Dlala Nje Foundation tours, experiences and events
These Terms and Conditions apply to bookings for tours, experiences and events organised by Dlala Nje Foundation (NPO 159-432), referred to in this document as “Dlala Nje”, “we”, “us” or “our”.
By making a booking, you agree to these Terms and Conditions. Please read them before confirming your booking.
1. About our experiences
Dlala Nje offers tours, educational experiences, community experiences and events designed to introduce visitors to the people, places, stories and communities of Johannesburg.
Our experiences may take place in public spaces, residential and commercial areas, buildings, stairwells, elevated locations and other environments that differ from conventional tourist attractions or formal event venues.
Conditions can vary from one experience to another. Participants should be prepared to walk, use stairs, navigate uneven surfaces, encounter crowds and move through active urban environments where other people are going about their daily lives.
We aim to provide welcoming, informative and responsibly managed experiences. Participants are expected to follow reasonable guidance from our team and behave respectfully towards residents, fellow visitors, staff and other members of the public.
2. Bookings and payment
A booking is subject to availability and confirmation by Dlala Nje.
The price, date, time, duration, meeting point and other relevant details will be provided during the booking process or in the booking confirmation.
Bookings must be made using accurate information. Participants are responsible for checking their booking details and arriving at the designated meeting point at the stated time.
Where a booking is made for a group, the person making the booking is responsible for communicating the relevant booking information and these Terms and Conditions to the group.
Payment must be made in accordance with the instructions provided during booking. A booking is not guaranteed until any required payment has been received and confirmation has been issued.
Any special arrangements must be agreed with Dlala Nje in advance.
3. Booking on behalf of other people
A person making a booking for a group confirms that they are authorised to make the booking and provide the relevant booking information on behalf of that group.
The person making the booking should ensure that all participants are informed about the nature of the experience, the practical requirements and the applicable safety guidance.
Making a group booking does not automatically give the person booking the authority to waive another adult’s legal rights or accept legal liability on that adult’s behalf.
Where an individual participant is required to acknowledge risks or agree to specific participation conditions, that acknowledgement must be obtained from the participant or, where legally appropriate, their parent or legal guardian.
However, it is expected and accepted that a person making a booking on behalf of a group for tours, experiences and events organised by Dlala Nje Foundation (NPO 159-432) has the authority to make the booking.
4. Understanding the nature of our experiences
Participants acknowledge that Dlala Nje experiences may take place in active urban environments and may involve physical activity, walking, climbing stairs, changes in elevation, uneven surfaces, traffic, crowds, weather conditions and other circumstances associated with the particular experience.
Depending on the experience booked, participants may also encounter heights, confined or busy spaces, public transport routes, ordinary building activity and other environmental conditions.
These circumstances may create risks such as slips, trips, falls, minor injuries, loss of personal belongings or other incidents.
The specific risks will depend on the experience, location and conditions on the day. Participants should consider their own circumstances and suitability for the activity before attending.
Where an experience involves a particular or unusual risk that requires specific notice, Dlala Nje will draw that risk to participants’ attention before participation.
5. Safety and guidance
Participants must follow reasonable safety instructions and guidance provided by Dlala Nje staff, guides, event organisers and authorised venue personnel.
Participants must not deliberately put themselves or others at risk, interfere with safety arrangements, enter restricted areas or disregard instructions intended to protect participants or members of the public.
Dlala Nje reserves the right to modify an activity, restrict access to a particular area or ask a participant to stop participating where reasonably necessary for safety, security, the well-being of others or compliance with venue requirements.
Where a participant’s conduct creates a serious or immediate risk, Dlala Nje may remove that participant from the experience. Any resulting refund will be considered in accordance with applicable law and the circumstances.
6. Participant responsibilities
Participants are responsible for:
- Arriving on time and following the joining instructions.
- Wearing suitable clothing and footwear for the activity.
- Considering their own fitness, mobility and other relevant personal circumstances.
- Keeping personal belongings secure.
- Treating guides, staff, residents and fellow participants with respect.
- Following applicable laws, venue rules and reasonable instructions.
- Informing Dlala Nje in advance of any assistance or reasonable accommodation they may need.
Participants must not attend or continue participating while impaired by alcohol, drugs or another substance to a degree that compromises their safety or the safety of others.
Aggressive, abusive, discriminatory, threatening or disruptive conduct will not be tolerated.
7. Health, mobility and accessibility
Some experiences may involve extended periods of walking or standing, stairs, uneven terrain, limited seating or locations that are not fully accessible to people with particular mobility requirements.
Participants should review the description of their chosen experience and contact Dlala Nje before booking if they have questions about accessibility or suitability.
We will consider reasonable requests for assistance or accommodation where practicable. However, the physical characteristics of certain buildings, routes or venues may limit the adjustments that can be made.
Participants should not feel obliged to disclose unnecessary personal medical information. Where relevant information is voluntarily provided, it will be handled in accordance with applicable privacy law.
8. Children and young people
Children and young people must be booked in accordance with the age requirements and supervision arrangements specified for the particular experience.
A parent or legal guardian is responsible for ensuring that a child is appropriately supervised and understands the relevant instructions.
Where parental or guardian consent is required, it must be obtained before the child participates.
The adult making a booking for a child confirms that they have the necessary authority to do so. This does not remove any legal duty owed to the child by Dlala Nje or another person.
9. Personal belongings and valuables
Participants are responsible for their own personal belongings, including phones, cameras, jewellery, bags and other valuables.
We recommend bringing only what is reasonably necessary for the experience and keeping valuables secure, particularly in busy public environments.
If an item is lost or left behind, participants should contact Dlala Nje as soon as possible. We will make reasonable efforts to assist, but cannot guarantee that lost property will be recovered.
Nothing in this section excludes liability where the law does not permit it.
10. Respect for communities and other people
Dlala Nje’s work is rooted in community engagement and challenging perceptions through meaningful experiences.
Participants must respect the dignity, privacy and rights of people encountered during tours and events. Harassment, intimidation, discriminatory behaviour or deliberately intrusive conduct is not acceptable.
Participants must follow any guidance about photography, filming, interviews and access to private or restricted spaces.
Permission should be obtained before photographing or recording identifiable individuals where appropriate, particularly children and people in circumstances where privacy should reasonably be expected.
Participants must not represent Dlala Nje, speak on its behalf or use its name or branding for commercial or public purposes without prior permission.
11. Photography, filming and recording
Participants may take photographs or make recordings where this is permitted by the particular experience, venue and applicable law.
Dlala Nje may also take photographs or recordings for documentation, reporting or promotional purposes. Where identifiable participants are to be used in promotional material, we will obtain any consent required by applicable law.
Agreeing to these Terms and Conditions does not, by itself, constitute blanket consent to the use of a participant’s image for marketing.
Participants who do not wish to appear in promotional photographs or recordings should inform the team before the experience so that reasonable arrangements can be considered.
12. Changes, cancellations and refunds
Dlala Nje may occasionally need to change the timing, route, venue or arrangements for an experience because of weather, safety concerns, access restrictions, operational requirements or circumstances beyond our reasonable control.
Where a material change or cancellation occurs, we will communicate with affected participants as soon as reasonably practicable and explain any available options.
The cancellation, rescheduling and refund terms applicable to a booking will be disclosed during the booking process or in the booking confirmation.
Participants who wish to cancel or change a booking should contact Dlala Nje using the details provided in their confirmation. Any applicable notice periods, fees and refund arrangements will be assessed according to the disclosed booking terms and applicable law.
Nothing in this section limits a participant’s statutory rights, including any right to a refund or other remedy that may apply under South African law.
A short version of the booking, rebooking and refund rules is on our page about cancellations and refunds for tours. Items from the shop follow our return policy.
13. Assumption of ordinary risks
By booking and participating, participants acknowledge that the experience may involve ordinary risks associated with the activity and environment, including slips, trips, falls, changes in weather, uneven surfaces, crowds and other conditions reasonably associated with the particular experience.
Participants agree to take reasonable care for their own safety, make informed decisions about participation and follow the guidance provided by the Dlala Nje team.
This acknowledgement does not mean that every possible risk is accepted, nor does it remove Dlala Nje’s legal responsibilities. Any unusual or significant risk requiring specific disclosure will be brought to participants’ attention separately where required by law.
14. Liability and indemnity
Dlala Nje takes reasonable steps to organise its experiences responsibly and to communicate relevant safety guidance.
To the extent permitted by applicable law, participants accept responsibility for loss or damage arising from their own unlawful conduct, deliberate misconduct or failure to follow reasonable safety instructions.
Where a participant’s actions cause loss, damage, injury or a claim by another person, that participant may be responsible to the extent that the law makes them liable.
Nothing in these Terms and Conditions excludes or limits liability for gross negligence, fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms and Conditions removes rights afforded to consumers under the Consumer Protection Act or any other applicable law.
The assumption of risk and indemnity provisions apply only to the extent that they are lawful, reasonable and enforceable in the circumstances.
15. Events and venue requirements
Participants attending Dlala Nje events must comply with the conditions applicable to the event venue, including any capacity limits, access restrictions, age requirements or security procedures.
Dlala Nje may refuse entry or ask a participant to leave where reasonably necessary because of unsafe, unlawful or seriously disruptive conduct, or where required by the venue.
Any event-specific conditions communicated during booking form part of the applicable booking arrangements, provided they are consistent with applicable law.
16. Personal information
Dlala Nje collects and uses personal information where reasonably necessary to manage bookings, communicate with participants, organise experiences, meet legal obligations and protect the safety and security of participants.
Personal information will be handled in accordance with applicable data-protection law, including the Protection of Personal Information Act (POPIA).
Information will not be used for unrelated marketing purposes merely because a person has made a booking. Where separate consent is required for marketing communications or optional uses of personal information, that consent will be requested separately.
Participants may contact Dlala Nje with questions about the handling of their personal information. Our privacy policy explains what we collect, who we share it with and your rights.
17. Circumstances beyond our control
Events may be affected by circumstances outside Dlala Nje’s reasonable control, including severe weather, public disturbances, transport disruptions, venue closures, emergency situations, government restrictions or other unforeseen events.
Where such circumstances affect an experience, Dlala Nje will consider appropriate arrangements, including changes, postponement or cancellation, taking into account the circumstances, the booking terms and applicable law.
18. Complaints and enquiries
Participants who have a concern about a booking or experience are encouraged to contact Dlala Nje directly so that the matter can be considered and, where appropriate, resolved.
Complaints should include the booking reference, date of the experience and a clear description of the issue.
Nothing in this section prevents a participant from exercising any legal rights or pursuing any remedy available under applicable law.
19. Applicable law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law, including any consumer-protection provisions that apply to the booking.
20. Updates to these Terms and Conditions
Dlala Nje may update these Terms and Conditions from time to time. The version applicable to a booking will be the version presented or made available at the time of booking, subject to any changes agreed by the parties and applicable law.
Where a material change affects an existing booking, Dlala Nje will communicate the change where reasonably necessary.
21. Contact details
For questions about these Terms and Conditions, bookings, accessibility or safety arrangements, please contact Dlala Nje using the contact details published on our official website or included in your booking confirmation.
Important notice: These Terms and Conditions are intended to explain the responsibilities associated with Dlala Nje experiences. They do not remove any legal rights or responsibilities that cannot lawfully be excluded.
