[DECISION: legal review of indemnity wording]

This wording follows our terms and conditions. By accepting, I confirm that:

1. Our tours take place in active city environments. They can involve walking, climbing stairs, changes in height, uneven surfaces, traffic, crowds, weather and other conditions linked to the tour you book.
2. These conditions can cause risks such as slips, trips, falls, minor injuries and loss of personal belongings. The exact risks depend on the tour, the place and the conditions on the day. If a tour has a particular or unusual risk, we will tell you before you take part.
3. Some tours involve long periods of walking or standing, stairs, uneven ground, little seating or places that are not fully accessible. I have read the description of my tour. I know I can contact Dlala Nje before the tour with questions about accessibility or whether the tour suits me.
4. I accept the ordinary risks of the tour and its surroundings. I will take reasonable care for my own safety, make informed decisions about taking part, and follow the guidance of the Dlala Nje team.
5. I will follow reasonable safety instructions from Dlala Nje guides, staff and venue staff. I will not put myself or others at risk on purpose, interfere with safety arrangements, or enter restricted areas. Dlala Nje may change an activity, close off an area or ask me to stop taking part when this is needed for safety. I will not take part if alcohol, drugs or another substance makes me unsafe to myself or others.
6. I am responsible for my own belongings, such as phones, cameras, bags and valuables.
7. As far as the law allows, I accept responsibility for loss or damage caused by my own unlawful conduct, my deliberate misconduct, or my failure to follow reasonable safety instructions. If my actions cause loss, damage, injury or a claim by another person, I may be responsible to the extent that the law holds me liable.
8. A parent or legal guardian signs for any child under 18 and confirms that they have the authority to do so. They are responsible for supervising the child and making sure the child understands the instructions. This does not remove any legal duty that Dlala Nje or anyone else owes the child.

Accepting this does not mean I accept every possible risk, and it does not remove Dlala Nje’s legal responsibilities. It does not exclude or limit liability for gross negligence, fraud, wilful misconduct or any other liability that the law does not allow to be excluded. It does not remove my rights as a consumer under the Consumer Protection Act or any other law. These provisions apply only as far as they are lawful, reasonable and enforceable.

Dlala Nje uses the details on this form to manage bookings and keep guests safe, as set out in our terms and conditions and in line with the Protection of Personal Information Act (POPIA).
